Acknowledgment of Risk, Waiver of Liability, Indemnification & Image Release Form

1. Acknowledgment and Assumption of Risks

I (or my minor child, if signing as a parent/guardian) acknowledge and recognize that the Activities have inherent risks, as well as unknown/unanticipated risks, which could result in serious physical or emotional injury, illness (including communicable diseases such as MRSA, influenza, and COVID-19), paralysis, damage to myself and third parties, or death. These risks include, but are not limited to: overexertion, dehydration, injuries such as bruises, sprains, dislocations, fractures, and breaks, as well as illness or death. My participation in these Activities is purely voluntary, and I elect to participate in spite of the risks. I further certify that I have no medical or physical conditions which could interfere with my safety in these Activities, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by such conditions. I also agree to abide by any safety rules, guidelines, and instructions set forth by the Company (defined below).

2. Waiver of Liability

I, on behalf of myself and my heirs, executors, administrators, or any other person acting on my behalf or on behalf of my estate, hereby voluntarily and irrevocably release, forever discharge, and agree to indemnify and hold harmless Donald De La Haye, and their respective parents, subsidiaries, licensees, sponsors, successors, designees, and assigns, who will conduct the Activities and any of their respective shareholders, directors, officers, agents, employees, and all other persons acting on their behalf (collectively, the “Company”) from and against any and all claims, demands, causes of action, or costs and expenses (including attorney’s fees and costs to enforce this agreement) resulting in whole or in part, directly or indirectly, from my participation in the Activities.

3. Image Release

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I hereby irrevocably consent to and authorize the use by the Company of any and all photographs, video, voice recordings, or other media (whether now known or hereafter created) taken of me (or my minor child) by, in connection with, or on behalf of the Company, including derivative works thereof (collectively, the “Images”), and any reproduction of the Images in any form in any media whatsoever, whether now known or hereafter created, throughout the world in perpetuity, without payment or other consideration.

I also consent to the use of my (or my minor child’s) name or likeness (in whole or in part), or an assigned fictitious name, in connection with the exhibition, distribution, merchandising, advertising, exploiting, and/or publicizing of Images or Company, or for any other business purpose whatsoever.

I, on behalf of myself and my heirs, executors, administrators, or any other person acting on my behalf or on behalf of my estate, release and discharge the Company, its officers, employees, licensees, and affiliates from any and all claims, actions, suits, or demands of any kind or nature whatsoever, in connection with the use of Images and the reproduction thereof (including, without limitation, any claims for invasion of privacy, right of publicity, defamation, copyright infringement, or any other causes of action arising out of the use, distribution, adaptation, reproduction, broadcast, or exhibition of such Images, name or likeness, or assigned fictitious name).

I understand and agree that the Company will be the exclusive owner of all rights, including, but not limited to, all copyrights, in and to the Images in whole or part, throughout the universe, in perpetuity, in any medium now known or hereafter developed, and shall have the right to license others to use them in any manner the Company may determine in its sole discretion, without any obligation to me. To the extent that I am found to be the owner of any rights in and to the Images, in whole or part, I hereby irrevocably assign all of my rights in the Images to the Company. To the extent I cannot for any reason sell or otherwise assign all or any portion of my rights in the Images, I hereby grant the Company a worldwide, exclusive, royalty-free perpetual license to the Images, including the right to sublicense the Images to third parties and to use, copy, distribute, reproduce, modify, and make derivative works from the Images.

I hereby waive any right that I may have to inspect and/or approve the use of the Images or any reproductions thereof by the Company.

Parental/Guardian Consent (For Participants Under 18)

IF PARTICIPANT IS UNDER 18 YEARS OLD, A PARENT OR LEGAL GUARDIAN MUST READ AND SIGN BELOW:

I, the undersigned, am the parent or legal guardian of the minor participant named below. I acknowledge and accept the risks outlined in this Waiver and voluntarily allow my child to participate in the Activities. I understand that my child’s participation involves inherent risks and I accept full responsibility for any injury, illness, or damages that may occur. I agree to indemnify and hold harmless Donald De La Haye, and their affiliates from any claims related to my child’s participation.

Medical Authorization and Release of Liability

In the event of a medical emergency during the event, I authorize Donald De La Haye (Deestroying), and anyone working with them to obtain emergency medical care for my child if needed. I understand and agree that I am fully responsible for any medical expenses that may arise.

I hereby release and hold harmless Donald De La Haye, their staff, partners, and affiliates from any and all liability, claims, demands, or actions arising out of or relating to any medical treatment or emergency care provided. I understand that this release applies to any injury, illness, or outcome resulting from participation in this event or any medical response associated with it.
